Yonkers, New Rochelle, and White Plains Family Court Attorney
There are a wide variety of case types within the practice area of family law, each with its own set of rules.
Each case type has its own unique complexities, circumstances, and nuances. but all are legally, personally, and emotionally challenging for the individual family members involved and for the family as a whole.
It is worth noting that Divorce cases are heard in NY Supreme Court, not in Family Court.
As you might expect in such a heavily populated state, the Family Court system in New York is an extremely busy one.
In Westchester County, there are three Family Court locations: White Plains, Yonkers, and New Rochelle.
In New York City, there are five Family Courts, one for each individual borough: Bronx, Manhattan, Queens, Brooklyn (Kings County), and Staten Island.
In Rockland County, the Family Court is located in New City.
Among the matters that are heard in Family Courts in New York State:
- Child-related issues such as Child Custody and Visitation, Child Relocation and Child Support
- Enforcement of and modification to any existing judgements and orders
- Adoption, including stepparent adoption, family relative adoption, as well as foster care approval and review, and legal guardianship cases
- Paternity, including filing petitions aimed at legally establishing or denying paternity
- Child Abuse and Neglect
- Grandparent Rights, Grandchild Visitation
- Domestic Violence and Abuse, Orders of Protection
- Spousal Support
- Juvenile Delinquency issues and Persons in Need of Supervision (PINS)
With regard to Domestic Violence and Child Abuse and Neglect and contested Child Custody, the court must, by legal statute, always consider domestic violence and child abuse allegations in their decision to determine custody.
